ITINERANT MERCHANTS

11.08.070 Exemption.

11.08.010 License Required. It shall be unlawful to do business in the City as an itinerant merchant without having first secured a license therefor as is herein provided. For the purpose of this ordinance, any merchant engaging or intending to engage in business as a merchant in the City for a period of time not exceeding one hundred (100) days shall be considered as an itinerant merchant, provided that peddlers shall not be considered itinerant merchants.

11.08.020 Applications. Every application for such a license shall set forth the commodities to be sold, and the place intended to be occupied or used for the business.

11.08.030 Fee. The fee for such license shall be $5.00 per day.

11.08.040 Fraud. Any licensed itinerant merchant who shall be guilty of any fraud, cheating, or misrepresentation, whether through himself or through an employee, while acting as an itinerant merchant of the City or who shall barter, sell, or peddle any goods, or merchandise, or wares other than those specified in his application for license, shall be deemed guilty of a violation of this ordinance.

11.08.050 Penalty. Any person, firm, or corporation violating any provision of this ordinance shall be fined not less than $5.00 nor more than Five Hundred Dollars ($500.00) for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

11.08.060 Street Itinerant Merchants. No itinerant merchant shall engage in business on any street, sidewalk, park, parkway, or in any other public place unless his itinerant merchants license specifies doing business in such public places is permitted thereunder.

11.08.070 Exemption. This Chapter shall not apply to farmers and growers selling their own products.
