PEDDLING ICE CREAM, CANDY, CONFECTION OR BEVERAGE

11.10.010 License Required. It shall be unlawful to sell or offer for sale, or to peddle, any ice cream, candy, confection or beverage for human consumption from any vehicle, including motor vehicles and non-motorized vehicles, on any public street, alley or parkway in the municipality without having a license therefor.

11.10.020 ApplicationFee. Application for such licenses shall conform to the regulations of the Chapter relating to all such applications. The annual fee shall be twenty-five dollars ($25.00). The fee for daily licenses shall be Five Dollars ($5.00).

11.10.030 Traffic Hazard. It shall be unlawful to permit any such vehicle to stand or remain in any place where parking vehicles is prohibited, or to sell or offer any commodity for sale on any through street, or at any place or time when an unusual traffic hazard or danger to prospective customers exists; or within two hundred feet of the scene of any accident or destructive fire or any place where the members of the fire or police departments are responding to an emergency call.

11.10.040 Regulations. All such vehicles shall be kept in a clean and sanitary condition and shall be thoroughly cleaned each day they are so used. It shall be unlawful to permit stale foods, decaying matter, or any other waste material or product to accumulate in or on any such vehicle while it is so used.

If unwrapped foodstuffs are transported in any vehicle, such foods shall be carried in a portion or compartment of the vehicle which is screened and protected against dust and insects.

11.10.050 Temperature Control. Readily perishable foods or beverages, while in transit, shall be maintained at a temperature of not less than 35 degrees Fahrenheit and not more than fifty degrees F. The temperature for hot liquid foods or beverages shall be maintained at not less that 150 degrees F.; and for frozen foods at not more than 32 degrees F. The compartments in vehicles used for carrying such food shall be so constructed, equipped and maintained as to pre serve the temperature as above indicated for the respective types of food.

11.10.060 Inspections. It shall be the duty of the Mayor to make or cause to be made such inspections as may be necessary to insure compliance with the provisions of this ordinance.

11.10.070 Penalty. Any person, firm, or corporation violating any provision of this chapter shall be fined not less than twenty-five Dollars ($25.00) nor more than Two Hundred Fifty Dollars ($250.00) for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues.

Any license issued under the provisions of this chapter may be revoked by the City Clerk for any violation of any regulation hereof, and such revocation shall be in addition to any fine imposed by virtue of this chapter.
