GENERAL PROVISIONS

Sec. 6-3 APPOINTMENT/REMOVAL OF ADMINISTRATOR

The Mayor with the advice and consent of the City Council shall appoint, as Administrator, a veterinarian licensed by the State of Illinois. Such appointments shall be made as necessary to keep this position filled at all times. The Administrator may appoint as many Deputy Administrators or Animal Control Wardens to aid him or her as authorized by the Council.

Sec. 6-4 DUTIES OF ADMINISTRATOR

It shall be the duty of the Administrator, through education, rabies inoculation, stray control, impoundment, quarantine, and any other means deemed necessary, to control and prevent the spread of rabies in this city, and to enforce the Humane care and treatment, and the adequate living space, shelter and protection from the elements, for all animals in the City of Fairfield. Compensation for the Administrator, if any, shall be funded by the Council.

Sec. 6-5 ANIMAL CONTROL WARDENS/APPOINTMENT/REMOVAL

The Administrator may appoint animal Control Wardens with approval of the Council to enforce the provisions of this Act. The Administrator, with consent of the Council may also remove an Animal Control Warden from service.

Sec. 6-6 DUTIES OF ANIMAL CONTROL WARDEN

Duties of an Animal Control Warden shall include issuance of and service of citations and orders for violations of this Act, the policing and inspection of all animals restrained or confined or running at large, within the City of Fairfield, and the apprehension and impoundment of animals found in violation of this Act, and the termination of such animals where found necessary.

Sec. 6-7 POWERS OF ANIMAL CONTROL WARDEN

The Animal Control Wardens are, for the purpose of enforcing this Act, clothed with power of police officers within the Municipality of Fairfield, Illinois, and as such police officers, have the power to make arrests on view or issue citations for violations of this Act and to execute and serve warrants and processes issued by the City of Fairfield, Illinois, or Wayne County Circuit Court; however, such police officers are prohibited from carrying firearms, but are authorized to carry pepper-mace, after proper training, to protect themselves from dangerous or vicious animals, and may use a tranquilizer gun or other equipment, to capture or contain animals. For the purpose of carrying out these provisions of the Act, and making inspections hereunder, the Administrator or Animal Control Wardens, or any officer of the law, may enter upon private premises to inspect, issue citations, serve warrants, or apprehend any animal in violation of this Act, or to destroy an animal if deemed necessary by such Officers. If an OWNER shall refuse a request by such Officers to deliver over an ANIMAL or a property OWNER refuses entry upon his property of Officers engaged in enforcing this ACT, they shall be in violation of this ACT.

Sec. 6-8 AGREEMENT

So as to provide the Administrator with the necessary trained personnel, equipment, supplies, facilities, and a State Licensed POUND/SHELTER, to carry out the Provisions of THE FAIRFIELD MUNICIPAL ANIMAL CONTROL ACT, the Fairfield City Council does enter in to an AGREEMENT with the PEARL FOVAL WAYNE COUNTY HUMANE SOCIETY to provide these services.
