Child Passenger Protection Act

ILLINOIS CHILD PASSENGER PROTECTION ACT

The law, amended effective January 1, 2004 requires anyone who transports children in Illinois in non-commercial vehicles to do so in the following manner:
  • Children under the age of eight years must be secured in an appropriate child restraint system, more commonly called a child safety seat.  Child safety seats include infant seats, convertible seats (rear-facing for infants an forward-facing for toddlers) and booster seats that are used with the vehicle lap and shoulder belt system.
  • Children weighing more than 40 pounds may be transported in the back seat of a motor vehicle while wearing only a lap belt if the back seat is not equipped with a lap and shoulder belt system for booster seat installation.
  • Children and young people eight and up to 16 years of age must be secured in a properly adjusted safety belt in any position in the vehicle.
  • The parent or legal guardian of a child under the age of eight years is responsible for providing a child safety seat to anyone who transports his or her child.
  • Every person under the age of 18 years who transports a child eight years of age or older (up to 18 years) is responsible for securing that child in a properly adjusted and fastened safety belt or child safety seat.

Those found in violation of the law the first time will be fined $50, which is waived upon proof of possession of an approved safety seat.  Subsequent violations are punishable by a $100 fine.

Children with physical disabilities that prevent the use of standard saety seats are exempt from the provisions of the law if the disability is duly certified by a physician.

PROPER CHILD SAFETY SEAT USE

Buckle Everyone. Children Age 12 & Under in Back!

INFANTS

Age & Weight: Birth to at least 1 year and 20-22 lbs.

Type of Seat: Infant only or rear-facing convertible

Seat Position: Rear-facing only

Always Make Sure: Children to at least 1 year and at least 20 lbs. in rear-facing seats. Harness straps at or below shoulder level.

Warning: Do not place infants in the front seat of cars with air bags.

TODDLER/PRESCHOOL

Age & Weight: Over 20 lbs. to about 40 lbs. and over 1 year.

Type of Seat: Convertible/Forward-facing

Seat Position: Forward-facing

Always Make Sure: Harness straps should be at or above shoulders. Most seats require top slot for forward-facing.

Warning: All children age 12 and under ride in the back seat.

YOUNG CHILDREN

Age & Weight: Over 40 lbs. up to about 80 lbs. or more

Type of Seat: Belt positioning booster seat

Seat Position: Forward-facing

Always Make Sure: Belt positioning booster seats must be used with both lap and shoulder belt.

Warning: Make sure the lap belt fits low and tight to avoid abdominal injuries.

Always fill out the registration card that comes with the seat in case of a recall.

SAFETY BELT LAW

Drivers and Passengers
625 ILCS 5/12-603.1

Each driver and front seat passenger shall wear a properly adjusted and fastened seat safety belt; except that a child less than 6 years of age shall be protected as required pursuant to the Child Passenger Protection Act [625 ILCS 25/1]. Each driver under the age of 18 years and each of the driver's passengers under the age of 18 years shall wear a properly adjusted and fastened seat safety belt. Each driver of a motor vehicle transporting a child 6 years of age or more, but less than 16 years of age, in the front seat of a motor vehicle shall secure the child in a properly adjusted and fastened seat safety belt.
